Terms of service

These terms are the agreement between you and Wow Themes ("we", "us"), 651 N Broad St, Suite 206, Middletown, Delaware 19709, United States, for using this website and buying our themes, plugins, templates and related services ("Products"). By creating an account or buying, you agree to them. If you are buying for a company, you confirm you may bind it.

Your account

You must give accurate details and keep your password private. You are responsible for what happens under your account. Tell us at support(at)wow-themes.com straight away if you think it has been misused.

What you are buying

A purchase gives you a license key that entitles you to download a Product, receive updates and get support for the number of sites and the period your plan states. Local and staging sites do not count towards your site limit.

• Yearly plans include updates and support for one year and renew automatically until you cancel. If you stop renewing, the Product keeps working but you no longer receive updates or support.
• Lifetime plans include updates for as long as we sell and maintain the Product.
• Your license key and the update and support service are personal to you. Do not share or publish your key, or use it for more sites than your plan allows.

Software licensing

The license that comes with each Product's download governs how you may use, modify and redistribute its code. Unless it says otherwise, the PHP, JavaScript and CSS code of our WordPress products is released under the GNU General Public License, version 2 or later, which lets you use, change and share that code under the same license. Images, fonts, icons, logos and other assets are licensed for use with the Product only, unless a file says otherwise, and our names and branding remain ours. Third-party components keep their own licenses, which are included with the Product.

Prices, payment and tax

Prices are in US dollars. Tax (such as VAT or sales tax) is calculated at checkout from your billing details and added where it applies. Payments are handled by Stripe. Subscriptions renew each year at the then-current price. We email you a reminder 30, 7 and 1 days before a license ends or renews, and you can see the date in your account at any time. You can cancel from your billing page whenever you like, effective at the end of the paid period. Stripe may also email you a receipt.

Refunds and your right to cancel

See our refund policy. It forms part of these terms. If you are a consumer in the EU or UK, you have a right to cancel within 14 days of buying. Because Products are digital, that right ends once you download the Product, which you confirm at checkout. Nothing in these terms limits any other right you have under consumer law, including for faulty or misdescribed products.

Updates, support and what we promise

We take care to supply Products that work as described, and to keep them working with current versions of the platforms they support, but we cannot promise they will work with every plugin, theme, host or setup. Support covers the Product as delivered, not custom changes or third-party code. If a Product is broken or does not conform to its description, you can ask us to fix it or to refund you, as the refund policy explains.

Acceptable use

Do not use the site or Products to break the law, infringe others' rights, attack or overload our systems, bypass license checks, or send us unlawful or abusive content. Do not use them where doing so would break United States export controls or sanctions, and do not buy from a country or as a person subject to them.

Reviews and content you give us

If you post a review or send us material, you confirm it is yours to give, and you let us display it on the site. We may remove reviews that are abusive, unlawful or not about the Product.

Our liability

Products are provided "as is". To the extent the law allows, we exclude all implied warranties and are not liable for indirect or consequential loss, lost profits, lost data or lost business. Our total liability to you for anything related to a Product is limited to the amount you paid for it in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, including for fraud, or for death or personal injury caused by negligence, or removes rights you have as a consumer.

Ending the agreement

You may stop using the Products and close your account at any time from Settings. We may suspend or end a license if you seriously or repeatedly break these terms, after warning you where it is reasonable to. If we end a license without fault on your part, we will refund the unused part of the paid period. Sections that by their nature should continue (such as liability and governing law) survive ending.

Changes

We may change these terms for future purchases and renewals. If a change matters, we will email account holders in advance. Changes do not affect a purchase you have already made unless the law or a security need requires it.

Governing law and disputes

These terms are governed by the laws of the State of Delaware, United States, and its courts have jurisdiction over disputes, except that if you are a consumer, mandatory laws of the country where you live still apply to you and you may bring a claim in your local courts.
